A class action law suit was filed in 83rd District Court in Fort Stockton against University of Texas Vineyard labor contractors.
Six farm workers filed the suit in June against FCI, Inc. and Don Murray of Odessa and Rogelio Vela, Leonardo Guerrero and Roberto Perales of Fort Stockton.
The suit alleges eight violations of the Migrant and Seasonal Agricultural Worker Protection Act (AWPA) by the defendants between 1983 and 1986 while providing farm workers to the vineyard east of Fort Stockton near Bakersfield.
According to Stephen C. McIntyre, Texas Rural Legal Aid, Inc. attorney at Hereford, the AWPA provides that if such a complaint is certified as a class action, the court shall award no more than the lesser of up to $500 per plaintiff per violation, or up to $500,000, or other equitable relief.
McIntyre attorney of record for the farm workers, said he hopes to have the case certified as a class action this summer.
