Legal Aid Group Files Labor Suits

Texas Rural Legal Aid (TRLA) in Hereford is suing a pickle distributing company, a Hale County farmer and a Mercedes contractor for alleged violations of federal labor and migrant farm workers laws.

The suit was filed Friday in Lubbock’s U.S. District Court on behalf of Jose and Irma Fuentes and their four children.

TRLA attorney Stephen McIntyre said the suit involves claims of violating the Fair Labor Standards Act and the Migrant and Seasonal Agricultural Worker Protection Act.

Named as defendants are Southwest Pickle Inc., C.P. Smith of Hale County and Eugenio Garcia of Mercedes. The suit claims the defendants failed to provide working conditions in compliance with federal labor regulations during pickle harvest operations in 1985.

McIntyre said the plaintiffs are seeking damages for alleged violations of the migrant worker protection act and failure on the part of the defendants to pay minimum wage.
